Terms of Service
Last updated: [date] · Version: draft
1. Who we are
THOST is a trading name of [legal entity name], [a company registered in England and Wales under number 00000000 / a sole trader], with its registered address at [address]. References to "we", "us" and "our" mean THOST. References to "you" mean the customer who orders services from us.
2. The services
We provide shared web hosting, email hosting and related services as described on our website at the time you order. Each plan's limits (websites, storage, databases and mailboxes) are set out on the pricing page and in your order confirmation.
3. Ordering and your contract with us
Your contract with us starts when we accept your order and provision your account. By placing an order you confirm that you are at least 18 years old and, if ordering for a business, that you are authorised to do so. At launch we accept orders from customers in the United Kingdom only.
4. Price and payment
Prices are shown in pounds sterling and [include / exclude] VAT. You may pay monthly or annually in advance. The price of your plan does not increase at renewal for as long as you remain on that plan. If we change our published prices, the change applies only to new orders and plan changes made after the date of the change. Payment is by debit or credit card through Stripe. If a payment fails we will notify you and may suspend the service if it remains unpaid after [X] days.
5. Cancellation and your right to change your mind
You may cancel at any time from the billing portal. Your service continues until the end of the period you have paid for and no further charges are made. If you are a consumer, you have the right to cancel within 14 days of placing your order under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013; if you asked us to start the service within that period, we may deduct an amount for the service provided up to the point you cancel. [Confirm refund policy.]
6. Acceptable use
You must not use the services for anything unlawful, or to send unsolicited bulk email, host malware or phishing content, infringe intellectual property rights, or place unreasonable load on shared resources. "Unlimited" limits are subject to fair use in a shared environment. We may suspend or terminate accounts that breach this section. [Link to a separate acceptable use policy if one is produced.]
7. Backups and your data
We take daily backups of your files and databases as a convenience and keep [X] days of history. Backups are not guaranteed and you remain responsible for keeping your own copies of your data. When your account ends, your data is deleted [X] days after the end date.
8. Availability and support
We aim to keep the services available at all times but do not guarantee uninterrupted availability. Planned maintenance will be announced in advance where practical. Support is provided by email at [email protected] during [hours].
9. Our liability
Nothing in these terms limits our liability for death or personal injury caused by negligence, fraud, or anything else that cannot be limited by law. Otherwise, our total liability to you in any 12-month period is limited to the fees you paid us in that period, and we are not liable for loss of profit, business or data, or for indirect or consequential loss. [To be reviewed.]
10. Changes to these terms
We may update these terms from time to time. We will give you at least 30 days' notice of material changes by email. If you do not accept the changes you may cancel before they take effect.
11. Governing law
These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction, except that consumers resident in Scotland or Northern Ireland may bring proceedings in their local courts.
